#1. The ethics of big data as a public good: which public? Whose good?

International development and humanitarian organizations are increasingly calling for digital data to be treated as a public good because of its value in supplementing scarce national statistics and informing interventions, including in emergencies. In response to this claim, a ‘responsible data’ movement has evolved to discuss guidelines and frameworks that will establish ethical principles for data sharing. However, this movement is not gaining traction with those who hold the highest-value data, particularly mobile network operators who are proving reluctant to make data collected in low- and middle-income countries accessible through intermediaries. This paper evaluates how the argument for ‘data as a public good’ fits with the corporate reality of big data, exploring existing models for data sharing. I draw on the idea of corporate data as an ecosystem involving often conflicting rights, duties and claims, in comparison to the utilitarian claim that data's humanitarian value makes it imperative to share them. #2. Building an Open Source Institutional Repository at a Small Law School Library: Is it Realistic or Unattainable?

Digital preservation activities among law libraries have largely been limited by a lack of funding, staffing and expertise. Most law school libraries that have already implemented an Institutional Repository (IR) chose proprietary platforms because they are easy to set up, customize, and maintain with the technical and development support they provide. The Texas Tech University School of Law Digital Repository is one of the few law school repositories in the nation that is built on the DSpace open source platform.1 The repository is the law school’s first institutional repository in history. It was designed to collect, preserve, share and promote the law school’s digital materials, including research and scholarship of the law faculty and students, institutional history, and law-related resources. In addition, the repository also serves as a dark archive to house internal records.

#4. Can WTO Member States Rely on Citizen Concerns to Prevent Corporations from Importing Goods Made from Child Labour?

There has been a polarised debate on the desirability of import restrictions to increase corporate accountability for child labour that occurs in global supply chains. Some scholars have indicated that states in favour of imposing import restrictions could sidestep this debate relying upon the perceptions that people in the importing market might have. They have based this argument on the case law of the World Trade Organization’s Dispute Settlement Mechanism (WTO DSM). The attitude-behaviour gap has, however, been largely overlooked in their analyses. This behavioural phenomenon provides an explanation as to why there is an inconsistency between what people value or believe and what they actually do. This essay revisits the WTO DSM's case law in order to determine whether such values or beliefs might justify import restrictions. On balance, this essay finds that the WTO DSM has not sufficiently taken the attitude-behaviour gap into account in its interpretation of Article III(4) and Article XX(a) 1994 General Agreement on Tariffs...
